Deciding to end a marriage, or unmarried co-parenting relationship, can be an extremely challenging decision and is often one of life's most difficult transitions. Moreover, the court process is frequently more complex and time-consuming than anticipated, requiring you to address significant matters such as finances, division of shared assets, spousal support. If you have children together, you'll also need to make arrangements for child support and determine how parenting responsibilities and time will be divided between households.


In Washington, divorces are handled on a “no-fault” basis. This means you’re not required to cite specific reasons for your separation other than stating the marriage is "irretrievably broken." There’s no need for either party to assign blame or explain why the relationship ended. Provided that one party wishes to proceed with the divorce and the legal procedures are followed, the court will approve the dissolution.


Legal proceedings can be lengthy, and the duration of a divorce varies. A 90-day waiting period is required after filing and serving the summons and petition before a divorce can be finalized. This waiting period allows time for possible reconciliation. On the other hand, if there's an agreement, things can generaly proceed more quickly.


 In either case, it's always best to consult with an experienced family law lawyer before proceeding, and while it’s not mandatory to hire one, it is highly recommended for cases in family court. The statutes and local rules can be complex, especially if children or large assets are involved. If your divorce is highly contentious, hiring a lawyer is in your best interests. You do not want to face the legal system on your own.
